The Department of Aging and Disability Services (DADS) in collaboration with Texas Board of Nursing (BON)
will be holding educational sessions for Home and Community-Based Services (HCS), Texas Home Living (TxHmL) and Intermediate Care Facilities for Persons with MR (ICFs/MR) providers/nursing staff and DADS surveyors/reviewers to learn about the new requirements of Senate Bill (SB) 1857 as well as to clarify the BON’s expectations regarding nursing scope of practice and delegation.
Senate Bill (SB) 1857, 82nd Legislature, Regular Session, 2011, adds Subchapter D-1 (Administration of Medication for Clients with Intellectual and Developmental Disabilities) to Chapter 161 of the Human Resources Code to allow an unlicensed person to administer specific categories of medications to certain individuals receiving HCS waiver services or TxHmL waiver services or residing in a licensed ICFs/MR with a capacity of 13 or fewer beds without registered nurse delegation.
SB 1857 also requires DADS and the BON to conduct a pilot program in HCS/TxHmL waivers and licensed ICFs/MR with a capacity of 13 or fewer beds to evaluate LVNs providing on-call services by telephone to individuals receiving services.
This educational offering will provide an opportunity for the nurse to learn the new statute that is person and practice setting specific. With person-focused needs at the forefront, the nurse will utilize critical thinking skills to problem-solve and provide a foundation to assess and evaluate current and future nursing practice.
